Dear Registrar: Re: Alexander Martin v Alphabet Inc., Google LLC, Google Canada Corporation, Apple Inc., and Apple Canada Inc. (CT-2025-004)

We ask that this letter be brought to the attention of Justice Little. Reference is made to the letters dated September 25, 2025 from Derek Ricci and Éric Vallières expressing an openness to having the oral hearing scheduled for October 22 and 23, 2025 be heard in person; and the letter dated September 26, 2025 from Albert Pelletier preferring that the hearing proceed by videoconference.

The Commissioner of Competition prefers to have the hearing occur by videoconference, maintaining the format set by the Direction to Counsel from Justice Little dated September 16, 2025. We consider both the costs of attending an in person hearing and the Commissioner’s limited role at the hearing. However, we recognize the Commissioner is not party to this proceeding and defer to the Tribunal’s preference regarding the format and place of hearing.
